Effective Date: January 1, 2026
These Terms and Conditions (the "Terms") form a single, unified agreement governing access to and use of the All Camps Kids website, online platform and related services (the "Platform"). By creating an account, enrolling in Membership, clicking "I Agree," or otherwise using the Platform, you agree to be bound by these Terms in a binding, legally enforceable agreement with All Camps Kids LLC, a Texas limited liability company ("All Camps Kids," "we," "us," or "our"). If you do not agree to these Terms, you may not use the Platform.
Definitions
For purposes of these Terms:
- "Camp" or "Camp Provider" means any independent third-party provider of camps, programs, or related services listed, linked, or otherwise made accessible through the Platform.
- "Camp Participant" means a Child who attends or participates in a Camp.
- "Child" means the minor on whose behalf a Parent/Guardian uses the Platform or enrolls in a Camp.
- "Membership" has the meaning set out in Section 3.
- "Parent/Guardian" means a User who is the parent or legal guardian acting on behalf of a minor.
- "Privacy Policy" means All Camps Kids' privacy policy available at https://www.allcampskids.com/privacy-policy, as updated from time to time.
- "User" means any individual or entity who accesses or uses the Platform.
These Terms incorporate by reference All Camps Kids' Privacy Policy, applicable Platform policies, fees, security standards, data use policies, community and conduct standards, and any other policies or notices presented on or through the Platform and updated from time to time (collectively, "Supplemental Terms"). In the event of conflict or any inconsistency concerning Platform use and the relationship among All Camps Kids and Users, the stricter or more protective requirement for All Camps Kids will apply unless expressly stated otherwise.
1. The Platform
All Camps Kids provides a membership-based information service to help Parent/Guardians discover children's Camps and related programs and, where available, access referral links or Camp website flows for sign-up. We are an information and discovery service.
We do not own, operate, manage, or control any Camps, programs, facilities, or Camp Providers; do not provide childcare, medical, educational, recreational, or counseling services; and are not a party to any agreement between any Users and any Camp or Camp Provider. We do not endorse, supervise, or control any Camps or Camp Providers and do not guarantee availability, suitability, quality, safety, compliance, or outcomes.
No partnership, joint venture, employment, fiduciary, or agency relationship is created between you and us, or between us and any Camp or Camp Provider. If expressly stated on the Platform, we may act as a limited payment collection agent solely for specified charges and solely to the extent permitted by law. Otherwise, all payments for camp services occur directly between you and the Camp or Camp Provider.
2. Eligibility and Parent/Guardian Authority
You must be at least 18 years old and have legal capacity to agree to these Terms. You represent and warrant that you are the Parent/Guardian of any Child whose information you provide; that you will provide only accurate and current information; and that you have all necessary rights and consents to submit a Child's personal information to the Platform for the purposes described in these Terms and our Privacy Policy.
Accounts may not be created by minors. The Platform is directed to adults acting on behalf of minors. You remain solely responsible for your account activity and for maintaining the confidentiality of your login credentials, including enabling multi-factor authentication where offered.
3. Membership Fees
Access to certain features may require an annual subscription plan (the "Membership") currently priced at $5 plus applicable taxes, which provides access to certain Platform features and benefits as described on the Platform from time to time. Membership fees are charged at enrollment and, unless you disable auto-renewal in your account settings prior to renewal, will automatically renew annually at the then-current rate. All fees are in U.S. dollars and are non-refundable except as expressly required by law.
We may change fees prospectively upon notice made through the Platform or by email. If you do not agree, you must cancel prior to the effective date of the change. You are responsible for any applicable taxes on fees. Payments are processed through third-party processors (e.g., Stripe) and are subject to their terms.
4. Platform Content; No Professional Advice
Camp listings and information on the Platform come from a combination of third-party sources, including Camps that provide their own information and public or licensed sources that may be aggregated or organized using automated tools. We do not guarantee the completeness, accuracy, timeliness, or reliability of any listing or recommendation.
Information on the Platform is for general informational purposes only and does not constitute childcare, medical, educational, legal, tax, or other professional advice. You are solely responsible for independently evaluating camps, verifying details (including age/eligibility, safety practices, staffing, accessibility, medical policies, and licensing), and making enrollment decisions.
NO DUTY TO VET; NO PROFESSIONAL ADVICE. THE PLATFORM AND LISTINGS ARE FOR GENERAL INFORMATION ONLY. ALL CAMPS KIDS DOES NOT VET, ENDORSE, CONTROL, OR GUARANTEE ANY CAMP, PROGRAM, PROVIDER, STAFF, POLICIES, SAFETY PRACTICES, BACKGROUND CHECKS, LICENSING, OR COMPLIANCE. ALL DECISIONS AND DUE DILIGENCE ARE YOURS ALONE.
5. Your Responsibilities and Assumption of Risk
You are solely responsible for:
- Verifying a Camp's policies, suitability, safety, staffing, qualifications, and compliance with laws;
- Obtaining any necessary medical advice, accommodations, or consents;
- Ensuring activities are age-appropriate and suitable for your child's needs and abilities; and
- Supervising your child's participation, including transportation, drop-off/pick-up, and adherence to camp rules.
ASSUMPTION OF RISK; PARENT RELEASE. YOU UNDERSTAND AND AGREE THAT CAMP ACTIVITIES INVOLVE INHERENT RISKS, INCLUDING ILLNESS, INJURY, AND PROPERTY DAMAGE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU (IN YOUR PERSONAL CAPACITY) VOLUNTARILY ASSUME THESE RISKS AND RELEASE ALL CAMPS KIDS LLC, ITS SUBSIDIARIES, AFFILIATES, SUCCESSORS, AND ASSIGNS, AND EACH OF THEIR RESPECTIVE OWNERS, DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, REPRESENTATIVES, SERVICE PROVIDERS, AND INSURERS (COLLECTIVELY, THE "RELEASED PARTIES") FROM ANY AND ALL CLAIMS YOU MAY HAVE ARISING OUT OF OR RELATING TO YOUR DECISIONS, YOUR CHILD'S PARTICIPATION IN CAMP ACTIVITIES, OR ANY CAMP, EXCEPT TO THE EXTENT CAUSED BY THE RELEASED PARTIES' GROSS NEGLIGENCE OR WILLFUL MISCONDUCT. FOR CLARITY, THIS PARAGRAPH DOES NOT PURPORT TO RELEASE ANY CLAIMS BELONGING TO YOUR CHILD.
6. Third-Party Camps and Services
Camps and other third-party services accessible via the Platform are independent third parties and not under our control. Links, referrals, or access flows to third-party sites are provided for convenience. We are not responsible for, and disclaim all liability arising from, third-party websites, policies, terms, practices (including background checks and staffing), acts, omissions, statements, services, or failures.
All disputes regarding Camp services, fees, availability, scheduling, safety, or conduct are solely between you and the Camp. Without obligation, we may facilitate communications; however, we are not responsible for resolving disputes or for issuing refunds for third-party services.
The Platform may link to or enable access to third-party websites, products, payment processors, identity verification providers, mapping or communications tools, or other services that are not controlled by All Camps Kids. Your use of such third-party services is subject to their terms, conditions, and privacy policies. All Camps Kids is not responsible for, and disclaims all liability arising from, third-party services.
7. Cancellations and Refunds
Unless expressly stated otherwise on the Platform for a particular All Camps Kids fee, (a) Membership fees are non-refundable, and (b) any refunds for Camp services are governed by the applicable Camp's policies and must be sought directly from the Camp. We do not control Camp refund policies and do not guarantee refunds.
THIRD-PARTY POLICIES CONTROL. REFUNDS, CANCELLATIONS, AVAILABILITY, SAFETY POLICIES, AND CONDUCT STANDARDS FOR CAMPS ARE SET BY THE CAMP AND NOT BY ALL CAMPS KIDS. ALL QUESTIONS OR DISPUTES ABOUT CAMP SERVICES MUST BE DIRECTED TO THE CAMP.
8. User Content; Prohibited Conduct
To the extent you submit content (e.g., profile information, reviews, comments, or messages) ("User Content"), you grant All Camps Kids a non-exclusive, worldwide, royalty-free, sublicensable license to host, reproduce, adapt, distribute, publicly display, and otherwise use such User Content to operate, improve, and promote the Platform.
You represent and warrant that you own or have necessary rights to your User Content and that it does not infringe third-party rights or violate law. You will not misuse the Platform, attempt to bypass its security, scrape at scale, post unlawful or infringing content, or use the Platform for any purpose not permitted by these Terms.
9. Beta Features and Experimental Tools
From time to time, All Camps Kids may offer features identified as beta, preview, pilot, or experimental. Such features may be modified, suspended, or discontinued at any time without notice and are provided "as is," without warranties of any kind, and may be subject to additional terms.
10. Privacy and Security
Our Privacy Policy explains what personal information we collect, how we use it, and your choices. By using the Platform, you consent to our data practices as described there.
Children's data: We generally collect limited Child profile information needed to provide matches and features the Parent/Guardian requests (e.g., first name, birthdate, interests, preferences, and other information you choose to provide). You represent that you are the Child's Parent/Guardian and authorize our collection and processing of the Child's information for the Platform's purposes. Do not provide more information than is necessary for your intended use of the Platform.
Security: We implement reasonable administrative, technical, and physical safeguards appropriate to the nature of the personal information we process. However, no method of transmission or storage is perfectly secure, and we cannot guarantee absolute security.
Incident response and notices: We maintain an incident response process and, if we determine that a security incident affecting personal information has occurred, we will provide notices as quickly as possible and without unreasonable delay and, in any event, no later than sixty (60) days after our determination of the breach, unless a law-enforcement delay applies. For incidents involving two hundred fifty (250) or more Texas residents, we will also notify the Texas Attorney General no later than sixty (60) days after our determination.
Third-party processors: We use third-party vendors (e.g., hosting, analytics, payment processing, identity/authentication) who may process personal information on our behalf subject to obligations consistent with these Terms and our Privacy Policy. Your use of certain third-party services is also subject to their terms and privacy policies.
11. Disclaimers
EXCEPT AS EXPRESSLY STATED IN THESE TERMS, THE PLATFORM AND ALL CONTENT AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT LISTINGS ARE ACCURATE OR COMPLETE, THAT CAMPS WILL BE AVAILABLE OR SUITABLE FOR YOUR CHILD, OR THAT THE PLATFORM WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.
12. Release and Indemnification
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU RELEASE ALL RELEASED PARTIES, AS PREVIOUSLY DEFINED, FROM ANY AND ALL CLAIMS, LOSSES, LIABILITIES, DAMAGES, COSTS, OR EXPENSES ARISING OUT OF OR RELATED TO CAMP SERVICES, CAMP PERSONNEL OR FACILITIES, CAMP POLICIES OR CONDUCT, YOUR OR YOUR CHILD'S PARTICIPATION IN CAMP ACTIVITIES, OR THIRD-PARTY WEBSITES OR SERVICES, EXCEPT TO THE EXTENT CAUSED BY THE RELEASED PARTIES' GROSS NEGLIGENCE OR WILLFUL MISCONDUCT.
INDEMNITY (EXPRESS NEGLIGENCE ACKNOWLEDGED). TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS THE RELEASED PARTIES FROM AND AGAINST ALL CLAIMS, LOSSES, LIABILITIES, DAMAGES, COSTS, AND EXPENSES (INCLUDING REASONABLE ATTORNEYS' FEES) ARISING OUT OF OR RELATING TO (A) YOUR BREACH OF THESE TERMS; (B) YOUR USER CONTENT; (C) YOUR USE OR MISUSE OF THE PLATFORM; (D) YOUR ENROLLMENT DECISIONS OR YOUR OR YOUR CHILD'S PARTICIPATION IN CAMP ACTIVITIES; OR (E) YOUR VIOLATION OF LAW OR THIRD-PARTY RIGHTS; EXCEPT TO THE EXTENT CAUSED BY THE RELEASED PARTIES' GROSS NEGLIGENCE OR WILLFUL MISCONDUCT. THE PARTIES EXPRESSLY INTEND THIS INDEMNITY TO COVER THE RELEASED PARTIES' OWN NEGLIGENCE TO THE EXTENT PERMITTED BY LAW.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW: IN NO EVENT WILL ALL CAMPS KIDS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUES, GOODWILL, OR DATA, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES; AND ALL CAMPS KIDS' TOTAL LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE PLATFORM WILL NOT EXCEED THE TOTAL MEMBERSHIP FEES YOU PAID TO ALL CAMPS KIDS DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.
The foregoing limitations apply to all theories of liability (contract, tort, negligence, strict liability, or otherwise) and are subject to the following carve-outs: Nothing in these Terms limits liability to the extent it cannot be limited under applicable law, or for losses caused by All Camps Kids' gross negligence or willful misconduct.
14. Intellectual Property
All Camps Kids owns the Platform and all related technology, software, trademarks, logos, and content, except for User Content and third-party materials. You may not use our marks without our prior written consent. If you provide feedback or suggestions, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use them without restriction or compensation.
All Camps Kids respects intellectual property rights. Users must not post content that infringes third-party rights. All Camps Kids may remove or disable access to allegedly infringing material upon receipt of a compliant notice and may terminate repeat infringers' accounts where appropriate. Procedures for notices and counter-notices are described in Platform policies.
15. Platform Integrity
You agree not to introduce malware, attempt to gain unauthorized access, or collect other users' personal information except as necessary to use the Platform as intended. You will use up-to-date, industry-standard security controls for your account and devices and promptly notify us of suspected compromise.
16. Force Majeure
We are not liable for delay or failure to perform due to events beyond our reasonable control, including but not limited to natural disasters, acts of government, public health emergencies, labor disputes not involving our workforce, terrorism, cyber incidents, or widespread utility or network outages. Remedies, if any, will be provided as required by these Terms and applicable policies.
17. Notices
You consent to receive notices and disclosures electronically. We may provide notices via the Platform, email, recognized courier, or certified mail to the contact information in your account. Notices are effective upon posting or delivery. You are responsible for keeping your contact information current.
18. Dispute Resolution
Before commencing litigation, the parties agree to attempt to resolve disputes through good-faith discussions and, if not resolved within thirty (30) days, non-binding mediation conducted remotely or in Travis County, Texas, unless the parties agree otherwise.
These Terms are governed by the laws of the State of Texas, without regard to conflict of laws principles. If a dispute proceeds to litigation, claims against All Camps Kids must be brought exclusively in the state or federal courts located in Travis County, Texas, and the parties consent to personal jurisdiction and venue in such courts. The prevailing party in an action to enforce these Terms is entitled to reasonable attorneys' fees and costs where permitted by law.
To the maximum extent permitted by law, disputes will be resolved only on an individual basis and not in a class, consolidated, or representative action. Each party knowingly and irrevocably waives any right to a trial by jury in any action, proceeding, or counterclaim arising out of or relating to these Terms or the Platform.
19. Changes to the Terms
We may modify these Terms from time to time. Material changes will be posted on the Platform or otherwise communicated and will take effect on the stated effective date. If you do not agree to the changes, you must discontinue use before the effective date. Continued use after the effective date constitutes acceptance.
20. Term; Survival
These Terms apply from acceptance and continue until terminated as provided herein. Users may terminate their Membership as provided herein. All Camps Kids may suspend or terminate any account immediately where All Camps Kids reasonably determines there is a violation of these Terms, a safety or legal risk, suspected fraud, or other conduct contrary to Platform policies. Provisions intended to survive termination, including payment obligations, confidentiality, indemnities, limitations of liability, and dispute resolution, will survive.
21. Assignment
You may not assign these Terms without our prior written consent. We may assign these Terms to an affiliate or in connection with a merger, acquisition, corporate reorganization, or sale of assets. No third party is an intended beneficiary of these Terms.
22. Severability; Waiver; Entire Agreement
If any provision of these Terms is found unenforceable, the remainder will remain in effect. No waiver is effective unless in writing and applies only to the specific instance. These Terms and the Supplemental Terms constitute the entire agreement between you and All Camps Kids regarding the Platform and supersede prior or contemporaneous understandings.
23. Additional Limits of Liability
Without limiting Section 13, All Camps Kids shall have no liability for: (a) loss, corruption, or recovery of data; (b) delays, outages, or errors arising from telecommunications, internet, or utility failures; (c) errors or omissions in profiles, descriptions, or representations by Users; (d) acts or omissions of third-party service providers; or (e) consequential damages arising from agreements between Camps/Camp Providers and Parents/Guardians.
